1. Acceptance of Terms

By accessing or using ERIE ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, free tier users, and paid subscribers.

ERIE Technologies, Inc. ("ERIE", "we", "us", or "our") reserves the right to update these Terms at any time. We will notify you of material changes via email or a notice within the platform. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use ERIE. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate, complete, and current.

3. Account Registration

To access most features of ERIE, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

ERIE reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

4. Subscription Plans & Billing

ERIE offers the following plans:

  • Basic — Available at no cost with usage limitations as described on our Pricing page.

  • Standard — Billed monthly as selected at checkout.

  • Pro — Billed monthly. Team features available as described on our Pricing page.

All payments are processed securely through our third-party payment provider. By subscribing to a paid plan, you authorize ERIE to charge your payment method on a recurring basis until you cancel. Prices are listed in USD and are subject to applicable taxes.

Annual subscriptions are billed upfront for the full year. Monthly subscriptions renew on the same date each month.

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not offer prorated refunds for mid-cycle cancellations unless required by applicable law.

5. Free Trial

Where offered, free trials are available to new users only. One free trial per person, per household. ERIE reserves the right to determine eligibility. At the end of the trial period, your account will automatically convert to the selected paid plan unless cancelled before the trial ends.

6. Intellectual Property & Ownership of Generated Content

Your Content All images, videos, and other visual outputs generated through ERIE on paid plans are owned by you. You retain full intellectual property rights to your generations, subject to the restrictions outlined in Section 7. Free tier generations are licensed for personal, non-commercial use only.

ERIE's Platform The ERIE platform, including its models, software, interface, documentation, and all underlying technology, is the exclusive property of ERIE Technologies, Inc. and is protected by intellectual property laws. You may not reverse engineer, copy, modify, or distribute any part of the platform without our written consent.

Uploaded Content By uploading images, sketches, or other assets to ERIE ("Input Content"), you grant ERIE a limited, non-exclusive license to use that content solely for the purpose of providing the Service to you. We do not use your Input Content to train our models without your explicit opt-in consent.

7. Acceptable Use Policy

You agree not to use ERIE to generate, distribute, or facilitate content that:

  • Depicts or sexualizes minors in any form

  • Constitutes hate speech, harassment, or incitement to violence

  • Infringes the intellectual property rights of any third party

  • Impersonates real individuals without their consent in a deceptive manner

  • Is intended to deceive, defraud, or manipulate others

  • Violates any applicable local, national, or international law

  • Is used to create non-consensual intimate imagery ("deepfakes") of real people

  • Promotes or glorifies self-harm, terrorism, or criminal activity

Violation of this policy may result in immediate account termination without refund. ERIE cooperates fully with law enforcement in cases involving illegal content.

8. Content Moderation

ERIE employs automated and human content moderation systems. We reserve the right to remove any generated content that violates our Acceptable Use Policy without prior notice. Repeated violations will result in permanent account suspension.

9. API Usage

Access to the ERIE API is available on paid plans. By using the API, you agree to our API Terms of Use, incorporated herein by reference. API usage is subject to rate limits as described in our documentation. Excessive or abusive API usage that degrades service for other users may result in throttling or suspension.

10. Third-Party Services

ERIE integrates with third-party tools and platforms (e.g., Adobe, Figma, Shopify). Your use of these integrations is subject to the respective third-party terms and privacy policies. ERIE is not responsible for the availability, accuracy, or practices of any third-party service.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. ERIE does not warrant that:

  • The Service will be uninterrupted, error-free, or fully secure

  • Generated outputs will meet your specific requirements or expectations

  • The Service will be free from viruses or other harmful components

To the fullest extent permitted by law, ERIE disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ERIE Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to ERIE in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless ERIE Technologies, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your generated content, or your violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive any right to participate in class action lawsuits or class-wide arbitration.
